What Is Sexual Abuse in New Jersey?
Sexual abuse is any sexual contact that the victim did not consent to.
Sexual abuse could include:
- Rape
- Unwanted groping
- Sexual harassment
- Molestation
- Forced touching of genitals
- Forced viewing of sexual acts
Sexual abuse can occur in many different settings, such as homes, places of worship, schools, and workplaces. In many cases, the perpetrator is someone the victim knows, which can make it difficult to speak up about the incident.
If you or a loved one was sexually abused, report the situation immediately; then seek legal help from our experienced New Jersey sexual abuse attorneys to get started on taking civil action against the perpetrator. We will help determine whom to sue, whether an individual or an institution, and which claims to bring.
Statute of Limitations for Filing Child Sexual Abuse Claims
Recently, New Jersey Governor Phil Murphy approved a bill that extends the statute of limitations for initiating childhood sexual abuse claims. The law, which went into effect in December of 2019, allows victims who were under 18 years of age at the time of the incident until they are 55 years of age to pursue civil action, or 7 years from the date they became aware of their injuries related to the act. Previously, they had only until they were 20 years of age.
Additionally, the legislation provides a two-year lookback window for individuals whose claims were barred under the previous statute of limitations. The lookback period runs from December 1, 2019 through November 30, 2021.
Recovering Fair Compensation in Sexual Abuse Cases in NJ
The effects of sexual abuse are many, and because each individual is unique, every case is different. Survivors of this crime may suffer physical wounds, which require medical treatment.
Although injuries can heal over time, victims of sexual abuse often sustain emotional scars that last for years. This can result in low self-esteem and difficulty developing and maintaining relationships in the future. The victim may require long-term therapy to attempt to cope with their experience.
Survivors of sexual abuse may be entitled to recover compensation for damages suffered. Our New Jersey sex abuse attorneys can utilize our resources to collect evidence regarding your situation and build a legal strategy for your case. We are committed to seeking justice on your behalf.
